APPLIED PROBLEMS OF OPTIMIZING THE PROTECTION OF INTELLECTUAL PROPERTY IN THE EEU AND THE RUSSIAN FEDERATION
Abstract
In the present article, the authors have carried out a comparative analysis of the lists of protected results of intellectual activity in the Russian Federation, in the countries of the EAEU, as well as in bilateral agreements of the CIS and EAEU participating states. It is noted that the system of protected objects of intellectual property of the Russian Federation can be supplemented by such categories as "innovative patent" (the Republic of Kazakhstan) and "scientific discovery" (the Republic of Ukraine). The authors also draw attention to some peculiarities in the use of the appropriate terminology and to judicial contradictions in establishing the range of subjects of intellectual property rights, in the regulation and mechanism for protection of these rights of the current Russian civil law, in its interaction and mutual influence with relevant regulatory legal acts of the EAEC, including acts of the system of customs and tariffs regulation, as well as to selected opportunities for its unification.
